Terms and Conditions
- DEFINITIONS
The following words or phrases have the meaning shown below wherever they appear in bold in this document.
We/Us/Our – Nicholas Wright TA Assurer Medical and Rescue or representative thereof (e.g. Instructors).
Awarding Body – the organisation responsible for the regulation and issuing of the final qualification on behalf of Assurer Medical and Rescue.
You/Your/Yourself – A person who has made a Booking alone or as part of a group with Us.
Armed Forces – Naval Service, Marines, Army or Air Force (including Reserve Forces).
Attend – participate in, take part in, use, or be present at.
Booking(s) – The pre-planned and pre-booked course(s), consultancy or clinical/rescue service transacted with Us by You.
Doctor – A qualified medical practitioner registered and licensed with a recognised professional body. A doctor cannot be You or a member of Your family.
Emergency Services – Police, Fire and Rescue Service or other Emergency Services.
Immediate family – Your husband, wife, partner, civil partner, parent, child, brother, sister, grandmother or grandfather.
Paying Party – Any organisation or body who has a legal liability to pay compensation for the failure of the service, against whom You have a right of refund.
- BOOKINGS
Where possible Bookings should be made via Our website. Where an alternative payment method is required, such as BACS or purchase order, You must contact us in writing (either by letter or email) and request an invoice to be raised.
Where Bookings are made via invoice, rather than on Our website, a space on the course will be held until the due date of the invoice. Once the due date for the invoice has passed the space on the Booking may be advertised on the website for sale, unless otherwise arranged with Us.
Bookings made via the website have priority over those made via letter or email and We cannot guarantee that there will be space available on the course when the letter/email request is processed.
Bookings made via the website should be acknowledged within 2 working days by Us. It is Your responsibility to follow-up the booking with Us by email or phone should confirmation not be received.
Tailored course Bookings will be supplemented with a terms of service agreement. This will include confirmation of services booked.
- PAYMENTS
Payments due to us…
Bookings made via Our website must be paid for in full through an online secure PayPal/debit card system at the time of booking.
Bookings made via letter or email will be charged by invoice that should be paid by BACS or a cardholder not present payment can be made over the phone.
Invoices must be paid in full within 30 days of the date on the invoice, unless otherwise arranged with US in writing.
Where a Booking occurs within the 30 day period of the invoice, We reserve the right to request a deposit of 50% of the course fee to secure a place on the course.
If an invoice remains unpaid in full at the end of the 30 day period We reserve the right to apply interest to the invoice in line with the Late Payments of Commercial Debts Act (1998). Interest will be charged at 8% above Bank of England base rate. We may also seek compensation for any debts owed. Breach of this term will result in legal action being instigated.
Payments due from us…
Invoices sent to Us should be received by post or email, clearly stating the amount owed, products/service description, invoice number and date, company and VAT details and payment options.
- CANCELLATIONS, TRANSFERS & REFUNDS
We provide, at our discretion, the option to transfer to another course or person if…
You are unable to Attend the Booking due to any of the reasons below, We may request evidence to support Your request.
- Illness / Injury
- Pre-existing Medical Condition
- Pregnancy Complication
- Death of Immediate Family
- Jury Service
- Court Summons
- Armed Forces & Emergency Services Recall
- Relocated for Work
- Government Travel Ban
We may also consider other Emergency Circumstances at our absolute discretion and You may need to evidence these circumstances.
Requesting a Transfer…
Should Your circumstances change and You are unable to Attend Your Booking We may offer a transfer or consider a request to transfer Your Booking to an alternative date or person. We may request evidence to support Your request in line with our cancellation terms.
To apply for a transfer to an alternative course date You must notify Us in writing (either by letter or email) as soon as You know You cannot Attend the Booking, and not less than 4 weeks prior to the Booking. We should acknowledge receipt of Your request within 2 working days. If You have not received acknowledgement You should contact Us by phone to confirm.
Applications for the transfer of the Booking to an alternative person will only be considered if requested no less than 5 working days prior to the Booking, and the final decision for transfer of the Booking rests with the Awarding Body. The transfer of any materials, to another person, issued prior to the course is solely Your responsibility, We will not re-issue any course manuals.
General conditions for transfer
- Requests for a transfer of course date made more than 4 weeks prior to the Booking will be processed at Our discretion and with no additional charges.
- Requests for a transfer of course date made between 4 and 2 weeks prior to the Booking will incur an additional charge of 20% of the course fee.
- Requests for a transfer of course date made less than 2 weeks prior to the Booking will incur an additional charge of 40% of the course fee.
- In the event that We have to cancel or postpone a course We will offer You the option to transfer to another course at no charge.
We provide refunds if…
You are unable to Attend the Booking due to any of the reasons below and have provided the required evidence.

Requesting a cancellation or refund…
Your refund application and payment will be handled by Us and will be processed in a fair and timely manner, in line with these terms and conditions.
To apply for a Refund You must notify Us in writing (either by letter or email) as soon as You know You cannot Attend the Booking or do have cancelled the event requiring our service. We should acknowledge receipt of Your request within 2 working days. If You have not received acknowledgement You should contact Us by phone to confirm.
If Your Booking is cancelled or postponed, You should contact Us to discuss Your options; see Your Booking confirmation for contact details.
General conditions of cancellation and refund
- You must make all arrangements to arrive in time to Attend the Booking.
- At the time of Booking You must not be aware of any reason which may lead to a refund request.
- You must take all reasonable precautions or make reasonable alternate arrangements to prevent or reduce any refund request.
- We will not pay a refund through this process where there is an existing right of compensation from another Paying Party, e.g. if your Booking is cancelled or postponed.
- You will be asked to provide supporting evidence at Your own expense, and a copy of the Booking
- Maximum refund value will not exceed the total value of the Booking.
- Following a successful request for a refund the following charges will apply (unless an alternative time frame is stated in the table below):
- Requests made more than 4 weeks prior to the Booking, no charge will be applicable and a full refund will be made.
- Requests made between 4-2 weeks prior to the Booking, a charge of 50% of the total course fee will be charged and a refund of 50% of the course fee will be made.
- Requests made less than 2 weeks prior to the Booking or without evidence being presented, a charge of 100% of the course fee will be made and Your refund request will be rejected.
- In the unlikely event that We are unable to attend a Booking due to circumstances beyond our control You will receive a full refund.

Means a complication of pregnancy You were unaware of at the time You made the Booking and which results in You being unable to Attend the Booking. |

| Death
Means Your death any time prior to the Booking or the death of an Immediate Family member or any person(s) in the Group due to Attend the event with You, up to 4 weeks prior to the date of the Booking. |

| Mechanical Breakdown
Means in the 24 hours prior to the Booking, the mechanical breakdown, accident, fire or theft of a vehicle taking You to the Booking |
If You did not leave sufficient time to travel to the Booking. If You did not make reasonable alternative arrangements to Attend the Booking |
Breakdown – A copy of the call out note from Your breakdown recovery service. An incident number or report from the Police or relevant traffic authority. |
| Home Emergency
Means a Burglary, Fire, Malicious Damage or Flood at Your private residence up to 48 hours immediately before the Booking, of which You were unaware of the time of making the Booking. |
Burglary, Flood, Malicious Damage – A Police reference number or evidence from the submission of a claim to Your home insurance company. Fire – A report from the fire service and/or police. |

| Jury Service
Means a summons for You to Attend Jury Service over the date of the Booking of which You were unaware at the time of making the Booking. |

| Court Summons
Means You are summoned to appear as a witness in court proceedings on the day of the Booking of which You were unaware of the time of making the Booking.

Any Court Summons in which You are a named Defendant in Criminal Proceedings or where You are the subject of Criminal Proceedings. |

| Armed Forces & Emergency Services Recall
Means You as a member of the Armed Forces, Reserve Armed Forces or Emergency Services are recalled to work on the date of the Booking or are posted overseas and cannot Attend the Booking.

You were aware of or had scheduled work on the date of the Booking, prior to making the Booking. You made an unsuccessful request for annual leave for the date of the Booking. |
A note from Your Commanding Officer or Line Manager to confirm being called into work or duty and that this was not Your original schedule. |
| Relocated for Work
Means a requirement to move address imposed on You by Your employer, unknown to You at the date of Booking. The move may be temporary or permanent and must be more than 100 miles from Your home address at the date of Booking.

Attendance at business meetings and business trips. The temporary relocation for work must be for a period of at least 3 months. |

| Adverse Weather
Means weather where a Government Agency has issued warnings not to travel which entirely prevents You from Attending the Booking.

| Government Travel Ban
Means You cannot Attend the Booking because of a public travel ban issued either by the government of Your country of residence or by the country You are travelling to, in the 7 days preceding the booking. |
Where Your government has issued a travel advisory or warning but not a ban to the country where the Booking is located. Where Your government has issued an internal travel ban or lockdown affecting the area, town, city or state in Your country where the Booking is located. Where You made the Booking after the Government Travel ban was already in force. Where any national or international body or agency has imposed or issued a travel ban, advisory, warning or restriction on the movement of people due to the outbreak of a Communicable Disease that prevents You from Attending Your Booking. If Your visa has not been obtained or has been declined. If Your Booking is cancelled or postponed and You have a right of refund, credit or voucher from another Paying Party. If Your Booking is postponed or rescheduled, unless You can evidence that You have a reason for not Attending on the rescheduled date which would be refundable under these terms. |

| Emergency Circumstances
Means an unforeseen circumstance completely outside Your control and of no fault of Yours. The decision to refund is entirely at the discretion of our Refunds Team. We will consider these circumstances and have no obligation whatsoever to provide a refund.

Specific reasons where refunds will not be provided:
We do not refund for non-Attendance of a Booking directly or indirectly associated with:
- actual or perceived: war, hostilities, civil commotion etc; imprisonment, repatriation, deportation etc; poisonous biological materials, radioactivity, etc; cyber-attacks; state property seizure, etc;
- failing to comply with any law;
- if it exceeds 18 months from the date originally booked to the conclusion of the transacted event
- other reasons controlled by You directly or indirectly not already mentioned above.
- COURSE SPECIFIC
If You are concerned that due to Your fitness or ability You are unlikely to take part fully in a course they should contact Us to discuss Your needs.
If the We have concerns over Your competence, attendance, behaviour or physical ability during a course We may be ask You to leave the course. In this case we reserve the right to offer no refund.
We accept no responsibility for the loss of course materials or certificates that are sent in the post. Proof of postage is obtained from the Post Office/Courier used.
It is Your responsibility to keeps inform us of any changes in contact details. This is particularly important as course materials and certificates may be sent some time after a Booking is made or following a course.
All assessment decision appeals should be made in line with Our Appeals Policy/Fair Assessment Policy.
Compliments and complaints regarding our service provision should be brought to Our attention at the earliest opportunity, either during the course or as soon as possible following the Booking to allow Us to investigate in a timely fashion.
